- Product customization options (swatches, checkboxes, radios, dropdowns)
- Canvas-based visual product previews with real-time updates
- Conditional logic for showing/hiding options
- Add-on product management and pricing
- Dynamic price display with add-on calculations
- Integration with Shopify themes via app blocks
- Order tracking with customization details
2.2 Platform Integration
- Designed for Shopify Online Store 2.0 themes
- Integrates with Shopify APIs and services
- Subject to Shopify's platform terms and policies
- Requires active Shopify store subscription
3. Eligibility and Account Requirements
3.1 Eligibility
To use Uplift Product Customizer, you must:
- Own or manage a Shopify store
- Be at least 18 years old or the age of majority in your jurisdiction
- Have legal authority to enter into these Terms
- Use an Online Store 2.0 compatible theme
- Comply with all applicable laws and regulations
3.2 Account Responsibilities
Shopify Store Requirements:
- Maintain an active Shopify subscription
- Ensure store compliance with Shopify's terms
- Provide accurate store and contact information
- Promptly update account information when changed
Security Obligations:
- Maintain confidentiality of account credentials
- Notify us immediately of unauthorized access
- Use strong passwords and security practices
4. Acceptable Use Policy
4.1 Permitted Uses
You may use Uplift Product Customizer for:
- Legitimate business purposes
- Product customization and option management
- Enhancing customer shopping experience
- Visual product configuration and previews
4.2 Prohibited Uses
You may NOT use Uplift Product Customizer for:
- Illegal activities or fraudulent purposes
- Violating intellectual property rights
- Distributing malware or harmful content
- Circumventing security measures
- Violating Shopify's Acceptable Use Policy
- Deceptive pricing or misleading customers
- Unauthorized data extraction or scraping
4.3 Content Restrictions
You are responsible for all content uploaded to the App, including:
- Product images and layer assets
- Swatch colors and patterns
- Option labels and descriptions
- Badge text and promotional content
Prohibited content includes:
- Copyrighted material without permission
- Trademark violations
- Offensive, discriminatory, or harmful content
- Content violating applicable laws
5. Pricing and Payment Terms
5.1 Subscription Plans
Uplift Product Customizer offers subscription plans billed through Shopify. Current pricing and features are displayed in the Shopify App Store and within the app.
5.2 Billing Terms
- All charges are processed through Shopify's billing system
- Subject to Shopify's billing terms and policies
- Subscription plans renew automatically unless cancelled
- You may cancel at any time through the Shopify admin
5.3 Refunds
Refund requests are handled on a case-by-case basis. Contact support for refund inquiries.
6. Intellectual Property Rights

- App software and source code
- User interface design and experience
- Documentation and help materials
- Trademarks and branding
- Proprietary features and algorithms

You retain ownership of:
- Product configurations you create
- Images and content you upload
- Store branding and design elements
- Customer data (subject to our Privacy Policy)
6.3 License Grant
By using the App, you grant us a limited license to:
- Process your content for service provision
- Display your configurations within the App
- Store and backup your data securely
7. Data Protection and Privacy
7.1 Privacy Compliance
Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.
7.2 Your Responsibilities
You are responsible for:
- Lawful collection of customer data
- Providing appropriate privacy notices to your customers

8. Service Availability and Support
8.1 Availability
We strive for high availability but do not guarantee uninterrupted service. The App may be temporarily unavailable due to:
- Scheduled maintenance (with advance notice when possible)
- Emergency maintenance or security updates
- Shopify platform issues or outages
- Circumstances beyond our reasonable control

9. Disclaimers
9.1 Service Provided "As Is"
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Merchantability or fitness for a particular purpose
- Uninterrupted or error-free operation
- Compatibility with all themes or configurations
- Accuracy or reliability of results
9.2 Platform Dependencies
The App's functionality depends on:
- Shopify platform availability and APIs
- Your theme's compatibility with app blocks
- Browser support for modern web technologies
- Proper configuration of your products and options
10. Limitation of Liability
10.1 Liability Limits
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Our total liability is limited to the fees you paid in the 12 months preceding the claim
- We are not liable for indirect, incidental, special, or consequential damages
- We are not liable for lost profits, data loss, or business interruption
- We are not liable for third-party actions or Shopify platform issues
10.2 Exceptions
These limitations do not apply where prohibited by applicable law or in cases of gross negligence or willful misconduct.
11. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorney fees) arising from:
- Your violation of these Terms
- Your misuse of the Service
- Content you upload or create
- Violation of third-party rights
- Your non-compliance with applicable laws
12. Termination
12.1 Termination by You
You may terminate your use of the App at any time by:
- Uninstalling the App from your Shopify admin
- Cancelling your subscription through Shopify
12.2 Termination by Us
We may suspend or terminate your access for:
- Breach of these Terms
- Non-payment of fees
- Violation of the Acceptable Use Policy
- Legal or regulatory requirements
12.3 Effects of Termination
Upon termination:
- Your access to the App will end immediately
- Your configuration data will be deleted per our Privacy Policy
- Outstanding fees remain due
- Provisions that should survive termination will remain in effect
13. Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes by:
- Posting the updated Terms with a new "Last Updated" date
- Notifying you through the App or email for significant changes
Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Rinkhouse Software operates, without regard to conflict of law principles.
15. Dispute Resolution
Any disputes arising from these Terms or your use of the App will be resolved through:

16. General Provisions

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
16.4 Assignment
You may not assign your rights under these Terms without our consent. We may assign our rights to a successor in the event of a merger, acquisition, or sale of assets.
16.5 Force Majeure
Neither party is liable for delays or failures due to circumstances beyond reasonable control, including natural disasters, government actions, network failures, or platform outages.
